1. Introduction

Welcome to MedClerk Mentor. These Terms of Service ("Terms") govern your use of the MedClerk Mentor website and platform (collectively, the "Service") operated by MedClerk Mentor Ltd ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

  • Platform: The MedClerk Mentor website and associated services.
  • User: Any individual who accesses or uses the Service, including Students, Doctors, and Administrators.
  • Student: A registered user with the role of "student" seeking medical education and mentorship.
  • Doctor: A registered user with the role of "doctor" providing medical education and mentorship.
  • Session: A scheduled teaching or mentorship interaction between a Doctor and one or more Students.

3. Account Registration and Eligibility

To use certain features of the Service, you must register for an account. When you register, you must provide accurate and complete information. You are responsible for safeguarding your password and for any activities or actions under your account.

To register as a Student, you must be:

  • At least 18 years old
  • Currently enrolled in a recognized medical school or program

To register as a Doctor, you must be:

  • At least 18 years old
  • A qualified medical doctor with current registration in your practicing country
  • Able to provide verification of your medical credentials if requested

We reserve the right to refuse registration or cancel accounts at our discretion. You must notify us immediately of any breach of security or unauthorized use of your account.

4. User Responsibilities

4.1 General Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable laws or regulations
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Share your account credentials with any third party
  • Use the Service to transmit any material that contains malware, viruses, or other harmful code

4.2 Doctor Responsibilities

As a Doctor, you agree to:

  • Provide accurate information about your qualifications, experience, and availability
  • Maintain professional standards during all interactions with Students
  • Notify Students in a timely manner if you need to cancel or reschedule a Session
  • Provide educational guidance within the scope of your expertise
  • Maintain appropriate professional boundaries with Students

4.3 Student Responsibilities

As a Student, you agree to:

  • Provide accurate information about your educational background and needs
  • Treat Doctors with respect and professionalism
  • Attend scheduled Sessions promptly or provide timely notice of cancellation
  • Use the knowledge gained through the Service ethically and responsibly

5. Sessions

5.1 Scheduling and Cancellation

Doctors may create availabilities for Sessions through the Service. Students may book these Sessions subject to availability. Both parties agree to honor their commitments to scheduled Sessions.

Cancellation policies:

  • If a Doctor cancels a Session less than 24 hours before the scheduled time, we reserve the right to record this as a service failure
  • If a Student cancels a Session less than 24 hours before the scheduled time, the Session may still count as completed for the Doctor
  • Repeated cancellations by either party may result in account restrictions

5.2 Session Content

Sessions are intended for educational purposes only. They do not constitute medical advice or treatment. Doctors should not provide specific medical advice about individual patients or cases.

Students understand that information provided in Sessions is for educational purposes and should not be used to make decisions about specific patient care without appropriate supervision.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of MedClerk Mentor Ltd and its licensors. The Service is protected by copyright, trademark, and other laws.

Materials shared during Sessions remain the intellectual property of their original creators. However, by sharing content during a Session, users grant other participants a non-exclusive license to use that content for their personal educational purposes.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MedClerk Mentor Ltd makes no warranties, expressed or implied, regarding the operation of the Service or the information, content, materials, or products included on the Service.

We do not guarantee that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Service will be accurate or reliable
  • The quality of any sessions, information, or other material obtained through the Service will meet your expectations

9. Limitation of Liability

In no event shall MedClerk Mentor Ltd, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

10. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service or any features or portions thereof without prior notice. We also reserve the right to update these Terms at any time. We will provide notice of any material changes to the Terms by posting the new Terms on the Service and updating the "Last Updated" date at the top of these Terms.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
